Structure & Powers
Cabinet-Level Agency reporting directly to the President
Leadership:
- Director: 6-year term, removable only for cause (independent from political pressure)
- Board: 15 members (5 workers, 5 technologists, 5 public interest advocates)
- NO corporate executives allowed on board
Budget: $50B/year (compare: the SEC gets $2B, they regulate $100T in assets. AI will be bigger.)
Staff: 50,000 employees
- 20,000 technical auditors (AI safety, computer scientists)
- 10,000 labor inspectors (job displacement monitoring)
- 10,000 environmental inspectors (data center enforcement)
- 5,000 truth/authentication experts (deepfake detection)
- 5,000 lawyers/prosecutors
1. Enforcement with TEETH
A. Pre-Approval Requirements:
ANY company wanting to:
- Deploy an AI model with 10B+ parameters
- Build data center using >50 megawatts
- Replace >100 workers with AI
Must get FAIA approval FIRST
Application requires:
- Environmental impact statement (energy, water, emissions)
- Labor impact statement (jobs displaced, retraining plan)
- Safety audit (bias, hallucinations, and failure modes)
- Public comment period (60 days minimum)
FAIA Can:
- Deny outright
- Approve with conditions
- Require bond (company must pay for displaced workers' retraining)
- Mandate ongoing monitoring
Penalty for deploying without approval: Model shut down immediately + $1B fine per day until compliance
B. Criminal Penalties for Executives
If your company:
- Deploys AI that displaces workers without retraining plan: 5 years in prison for the CEO
- Uses deepfake/synthetic media without watermark: 10 years in prison
- Exceeds environmental limits: 3 years in prison + personal liability for the cleanup
- Lies to FAIA about capabilities/impacts: 15 years in prison (same as securities fraud)
Why Criminal, Not Just Fines: Corporations treat fines as the cost of doing business. CEOs don't want to go to prison.
Asset Seizure: If an executive is convicted, then their personal assets are seized to fund remediation (displaced workers, environmental cleanup).
C. Instant Injunctions
FAIA can immediately shut down any AI system that:
- Produces deepfakes indistinguishable from reality
- Displaces >1,000 workers without a transition plan
- Causes environmental harm
- Shows bias causing measurable harm to protected classes
No lengthy court process - injunction first, the company can appeal later.
D. Mandatory Watermarking & Authentication
ALL AI-Generated Content MUST be Watermarked:
- Text: Cryptographic signature embedded
- Images: Visible + invisible watermark
- Video: Frame-by-frame authentication
- Audio: Frequency-based markers
Companies Must:
- Watermark at generation (can't be disabled)
- Maintain audit logs (who generated what, when)
- Provide free verification tools to public
Penalty for Removing Watermarks: $10M per instance + 5 years in prison
Why: If we can't tell what's real, then democracy dies. EVERY piece of synthetic media must be identifiable.
