1. Federal Evidence Authentication System (FEAS)

Create the National Infrastructure for Verifying Reality:

Blockchain-Based Photo/Video Registry:

  • Every camera (phone, DSLR, and security cam) registers with federal system
  • Photos/videos get cryptographic signature at moment of capture
  • Signature includes: device ID, timestamp, location, and hash of content
  • Signature stored on distributed blockchain (can't be altered)

How It Works:

  • You take photo → Phone signs it cryptographically → Upload to registry
  • Court case needs photo? → Check registry → If signature matches, it's authentic
  • No signature? → Treated as potentially fake, requires extensive authentication

Mandatory for:

  • All law enforcement bodycams (immediate upload)
  • Courtroom evidence (must be registered or extensively verified)
  • News media (optional but recommended)
  • Government communications (mandatory)

Cost: $10B to build infrastructure, $1B/year to operate

2. Deepfake Criminal Penalties

Creating/Distributing Deepfakes:

Political Deepfakes: (fake politician saying things they didn't)

  • 10 years in prison + $10M fine
  • If affects an election: 20 years + $100M fine + treason charges

Evidence Fraud: (fake evidence in legal proceedings)

  • 15 years prison + disbarment for lawyers
  • Obstruction of justice charges

Non-Consensual Porn Deepfakes:

  • 10 years in prison + $5M to victim
  • Sex offender registry

Commercial Fraud: (fake celebrity endorsements)

  • 5 years in prison + all profits seized + triple damages to victim

Exceptions: Clearly labeled satire/parody (must have visible disclaimer for the entire duration)

3. Court System Reforms

New Federal Rules of Evidence:

Rule 901(d) - AI-Generated Evidence:

"Evidence potentially generated or altered by AI is inadmissible unless proponent demonstrates: (1) Chain of custody from capture to presentation (2) Cryptographic authentication OR expert forensic analysis (3) Probative value substantially outweighs prejudice (4) No reasonable doubt about authenticity"

Default: If you can't PROVE it's real, then it's out.

Burden Shift: Currently, the challenger must prove it's fake. NEW: The proponent must prove it's real.

Forensic Funding: $5B/year for:

  • Federal forensic labs (20 regional centers)
  • Training for judges/lawyers
  • Public defender access to experts (can't have only rich defendants afford authentication)
